Falana Challenges Wike's Public Holiday for FCT Elections

Femi Falana, a human rights lawyer, has publicly criticized Nyesom Wike, the Minister of the Federal Capital Territory (FCT), over his declaration of a public holiday to restrict movement during the recent FCT area council elections. Falana contends that Wike does not possess the legal authority to declare such a holiday or impose movement restrictions, as he believes these powers are not granted to the minister by law.

Wike, speaking to journalists in Abuja, advised Falana to verify facts before making public comments, explaining that the restrictions were based on security reports indicating potential disruptions by hoodlums. Falana dismissed Wike's defense, asserting that the minister's actions were illegal and that the president lacks the power to authorize such restrictions during elections.

He emphasized that the Independent National Electoral Commission (INEC) should regulate electoral procedures without presidential control, referencing Section 160(1) of the Nigerian Constitution.
