Appeal Court Restores ADC and Four Parties' Registration

The Court of Appeal sitting in Abuja overturned the Federal High Court's ruling that ordered the Independent National Electoral Commission (INEC) to deregister the African Democratic Congress (ADC) and four other political parties. The unanimous judgment, delivered by a three-member panel led by Justice Abba Mohammed on Tuesday, declared the June 15 Federal High Court decision a nullity, stating it lacked jurisdiction and was based on an incompetent suit filed by a non-juristic entity.

The appellate court criticized the lower court for ignoring evidence that showed the parties had previously won elective positions and for proceeding with the case despite an earlier stay order issued on May 22. The Court of Appeal restored the registration of the ADC, Action Peoples Party, Action Alliance, Accord Party, and Zenith Labour Party, declaring them legally recognized by INEC.

It also awarded costs against the National Forum of Former Legislators, which initiated the suit.
