Court Awards N1.6M for Unremitted Pension Contributions

The Lagos Division of the Nigerian court awarded N1.6 million in damages to Deborah Obas against Dr. Physiq Global Health Well Ltd for the company's failure to comply with the Pension Reform Act 2014.

The court found that the company did not deduct or remit Obas's pension contributions during her employment. Justice Obaseki Osagha ruled that the company unlawfully suspended Obas and failed to remit her pension contributions, which included both employee and employer contributions, to her retirement savings account for the period from November 1, 2023, to September 25, 2024.

The court awarded Obas N1,100,936 as general damages for financial loss due to the company's failure to remit the funds, noting that she was deprived of accruing investment income. Additionally, the court granted N500,000 in legal costs in favor of Obas but dismissed her claims regarding unlawful suspension and workplace harassment, stating that the employer acted within the terms of her employment contract.
