Nigerian Court Upholds Host Community Liability Provisions in PIA

The Federal High Court in Warri, Nigeria, dismissed a suit brought by Churac challenging the host community liability provisions of the Petroleum Industry Act (PIA). The court affirmed the validity of the statutory framework governing Nigeria's oil and gas sector, ruling that the provisions were not unconstitutional or discriminatory.

The plaintiff failed to establish that the impugned sections of the PIA violated human rights or denied fair hearing. The court held that the National Assembly acted within its legislative competence in enacting the PIA.

The relief sought by Churac was dismissed in its entirety.
