Court Rules Against Police and FRSC Fines for Insurance

On a recent ruling delivered by Justice Hauwa Yilwa at the Federal High Court in Abuja, it was determined that the Nigeria Police Force and the Federal Road Safety Corps (FRSC) lack the authority to impose fines on motorists who do not possess third-party motor insurance without a court order. This judgment arose from a case filed by activist lawyer Marvin Omorogb against the Inspector General of Police and the Attorney General of the Federation, seeking clarification on whether security agencies could enforce penalties under the Motor Vehicle Third Party Insurance Act.

The court affirmed that while these agencies can ensure compliance with insurance laws, they cannot impose fines directly. The ruling is expected to impact the enforcement of traffic insurance regulations across Nigeria, particularly concerning penalties imposed on motorists.

Counsel for the applicant, Marvin Omorogb, indicated plans to appeal, while Victor Okoy, representing the defense, described the judgment as partially favorable.
