Court Rejects Suit Against ICPC Investigation Authority

The Federal Capital Territory (FCT) High Court sitting in Kurudu, Abuja, declined to entertain a suit filed against the Independent Corrupt Practices Commission (ICPC) that sought to restrain the commission from carrying out its statutory investigative functions. The application was brought by Mr.

Adediran Seyi of Equilibrium Management Limited following an invitation from the ICPC related to allegations of fundamental rights infringement. The court, presided over by Justice Katsina Alu, ruled on October 23, 2025, stating that the application did not comply with procedural requirements as stipulated in Section 46 of the 1999 Constitution (as amended) and Order II Rule 1 of the Fundamental Rights Enforcement Procedure Rules.

The ICPC, represented by counsel Mr. Lesli Iheduru, argued that the suit was speculative and lacked merit, emphasizing that an invitation to investigate does not constitute a violation of fundamental rights.

The court upheld the principle that law enforcement agencies must be allowed to perform their duties without hindrance.
