Court Bars Mamuda Beverage from Using Infringing Design

On Friday, a Federal High Court in Abuja, presided over by Justice Binta Nyako, granted a restraining order against Mamuda Beverage Nigeria Limited, prohibiting the use of a bottle design for its Pop Power Energy Drink that closely resembles the design of Rite Food Limited's Fearless Energy Drink. The court's decision followed a motion filed by Rite Food Limited, which alleged trademark infringement.

Mamuda Beverage had previously sought to dismiss the suit, claiming abuse of court process, but the court ruled in favor of Rite Food. Justice Nyako ordered Mamuda to cease production of the infringing product immediately and to destroy existing stock under court supervision.

The court has scheduled a hearing for the substantive suit on September 23, 2025. Despite a settlement agreement that included terms for Mamuda to desist from further violations, Rite Food reported that Mamuda reintroduced a modified version of Pop Power into the market, raising concerns about consumer confusion and brand integrity.
