Malami Rejects Corruption Findings in $2.7B Mambilla Arbitration

Abubakar Malami, who formerly served as Attorney-General of the Federation, has categorically denied involvement in corrupt dealings tied to the Mambilla Hydroelectric Power Project arbitration. Nigeria's triumph against Sunrise Power and Transmission Company Limited prompted Malami to issue a response via Mohammed Bello Doka, his media representative, on Tuesday.

The statement refuted suggestions that he participated in improper arrangements with Leno Adesanya, the Sunrise Power promoter, during discussions aimed at reaching a settlement. A 616-page award from the International Chamber of Commerce tribunal resulted in the rejection of claims mounted by Sunrise Power against Nigeria.

Tribunal observations reportedly included critical remarks regarding how Malami dealt with settlement discussions; however, he asserted that such findings ought not be treated as equivalent to determinations made in criminal proceedings. Nigeria's successful defence in these proceedings was welcomed by Malami, who also requested that citizens examine the complete arbitration documentation before forming judgments on his actions.

Malami's remarks stressed an important separation: commercial arbitration conclusions differ fundamentally from criminal adjudication determinations. According to his position, tribunal conclusions in a commercial context do not amount to establishing culpability as understood within law.

He called upon Nigerians to evaluate the tribunal's decision together with all relevant documents and evidence on record. Public attention to this matter has intensified following reports that Nigeria's anti-corruption authorities are investigating alleged improper agreements related to settlement discussions.

The Mambilla matter has persisted over an extended period, with Sunrise Power having sought $2.7 billion in compensation. Dismissal of these claims by the tribunal marks a pivotal moment in the dispute, yet questions concerning settlement negotiation procedures remain subjects of ongoing public examination.
