TNPA Signs 25-Year Deal Amid Legal Challenge from Capricorn

The Transnet National Ports Authority (TNPA) signed a 25-year agreement with petrochemical operators to improve energy security in South Africa. Transport Minister Barbara Creeci invoked a special rule to facilitate this deal.

However, the agreement is currently being challenged in court by Capricorn Petrochem, a black-owned company that seeks to have the court review and set aside the decision favoring existing operators such as BP and Vitol. Approximately three-quarters of South Africa's fuel import flow is managed through the Island View precinct at the Durban port, which serves as the country's main storage supply hub.

The TNPA's agreement includes provisions for third-party access and the establishment of mechanisms for new market entrants to access terminal capacity. Earlier in June, Creeci stated that the TNPA would issue a rationalization of site market via a special purpose vehicle.
