US Family Visa Guidelines for Immigrant Sponsorship

The US Department of State has outlined the conditions under which foreign citizens can obtain family-based immigrant visas to live permanently in the United States. To qualify, applicants must be sponsored by a close relative who is at least 21 years old and holds US citizenship or Lawful Permanent Resident (LPR) status.

The family-based immigration program recognizes two categories: the Immediate Relative visa, which includes spouses, children, and parents of US citizens and has no annual cap, and the Family Preference visa, which covers more distant relatives and is subject to annual limits. Specifically, US citizens can file immigrant visa petitions for four categories of relatives: spouses, sons or daughters, parents, and siblings.

The distinction between adult children and minor children is crucial, as adult children may fall under the Family Preference category, potentially affecting the duration of the visa process. The Department of State advises careful review of eligibility requirements before initiating the petition process.
