US Government Supports Elon Musk in EU Fine Challenge

The United States government has entered the legal dispute involving Elon Musk and X, requesting permission to intervene in their challenge against a €120 million fine imposed by the European Union. The US Department of Justice filed its application on September 24 before the General Court of the Court of Justice of the European Union in Luxembourg.

This legal action supports separate cases initiated by X Internet and X Holdings, along with Musk, aiming to annul the European Commission’s decision from December 2025. The Commission fined X €120 million under the Digital Services Act for violations related to its blue checkmark system, advertising transparency, and researchers' access to public data.

Assistant Attorney General Brett A. Shumate stated that the European Commission had overstepped its regulatory authority concerning American companies.

The US government argues that the court's ruling could have significant implications for other US-based digital services operating in Europe. The European Commission has not yet publicly responded to the US application.
