Judge Blocks Trump Immigration Rule on Foreign Students

Dennis Saylor issued a ruling in Boston that blocked the Trump administration's new immigration rule aimed at limiting the duration of stay for foreign students and journalists. The Department of Homeland Security (DHS) had planned to enforce this policy, which would have capped F visas for international students and J visas for cultural exchange participants at four years, while I visas for foreign journalists would have been limited to 240 days.

Judge Saylor sided with a coalition of trade unions and higher education groups, stating that DHS's justification for the rule was based on "exceptionally weak" reasoning and failed to adequately address objections or consider less burdensome alternatives. He noted that the proposed rule could lead to catastrophic damage to the higher education system, particularly affecting institutions like Harvard and the Massachusetts Institute of Technology, which rely heavily on international students.

DHS General Counsel James Percival criticized the ruling, arguing it would allow abuse of the immigration system. Miriam Feldblum, head of the Presidents' Alliance on Higher Education and Immigration, welcomed the decision as a preservation of the longstanding system for attracting global talent.
