Australia Enforces Strict Penalties for Visa Overstayers

Australia's Department of Home Affairs has issued a warning regarding the consequences for foreigners who remain in the country after their visa has expired. Staying in Australia without a valid visa is deemed unlawful.

Foreigners unable to secure a new substantive visa must leave the country or face escalating consequences. The first consequence is detention, where authorities can hold visa overstayers in immigration detention during case processing or removal arrangements.

The second consequence is forced removal from Australia, which can occur regardless of the individual's wishes. The third consequence involves financial liability, as overstayers may be billed for the full cost of their own removal.

Furthermore, any foreign national who departs Australia after overstaying for more than 28 days without a valid visa may be barred from future visa applications for up to three years, with limited exceptions noted by the department.
