Layonu Advocates Against Excessive Bail Conditions in Nigeria

Dr. Abiodun Layonu, a Senior Advocate of Nigeria, expressed strong support for the Nigerian Bar Association's (NBA) position on bail conditions during an exclusive interview with the Nigerian Tribune on Thursday.

He argued that bail should not become a punishment before trial and that excessive bail conditions undermine constitutional guarantees of personal liberty. Layonu emphasized the necessity for prompt and thorough criminal investigations, ensuring that suspects are arraigned in court without unnecessary delays.

He stated that investigations should be completed substantively before charges are filed to facilitate timely justice. Layonu also noted that while serious allegations may influence bail decisions, the court must exercise discretion based on individual case merits.

He reiterated that bail should secure an accused person's attendance in court and should not violate the principle of presumption of innocence, warning that onerous bail conditions could effectively deny this presumption.
