IRCC Reveals Exceptional Citizenship Granting Criteria

Immigration, Refugees and Citizenship Canada (IRCC) disclosed that foreigners can be granted citizenship through a discretionary process in rare and exceptional circumstances, bypassing standard naturalization rules. This information was provided in response to a question from MP Larry Maguire at the Standing Committee on Citizenship and Immigration on March 20, 2023, and published on December 5, 2024.

Under subsection 5(4) of the Citizenship Act, citizenship may be granted in three specific situations: special and unusual hardship, statelessness, and exceptional service to Canada. Each application is evaluated on its own merits, with a high bar for approval, indicating that most applicants will not qualify.

The IRCC does not track standard processing times for these cases due to their unique nature, and the resolution time depends on various factors, including documentation and background checks. The agency prioritizes cases involving lost Canadians, minors, and individuals who lost citizenship under Section 8 of the Citizenship Act.
