Court Rules Coroner's Inquest into Nkanu Esege's Death Must Proceed

A High Court in Ikeja dismissed an application by Euracare Multi-Specialist Hospital to stop a coroner's inquest into the death of Nkanu Esege, the 21-month-old son of Chimamanda Ngozi Adichie and Ivara Esege. Justice Aishat Opesanwo delivered the ruling on Monday, striking out the hospital's motion for writs of Certiorari and Prohibition.
The court found the hospital's arguments, including the claim that the inquest could not continue without a physical body, to be fundamentally flawed. Justice Opesanwo emphasized that under Section 15(2) of the Lagos State Coroner's System Law 2007, an inquest is mandatory when a death occurs within a facility, regardless of the presence of a corpse.
The hospital's assertion that requiring its staff to present evidence first violated its constitutional rights was also dismissed. Nkanu Esege died on 7 January 2026 at the hospital, with his parents alleging medical negligence, which the hospital denied.
The coroner's inquest is now set to proceed.
