Court Denies Bid to Halt Video in Corruption Case

On Wednesday, the Federal Capital Territory High Court in Abuja dismissed an application from lawyer Victor Giwa, who sought to prevent the playing of a video in a case alleging judicial corruption. Giwa is defending himself against charges of document forgery and impersonation.

The prosecution contended that the video was relevant and necessary for a just determination of the case. Giwa's defense argued that the video was fundamentally defective and inadmissible under Section 84(4) of the Evidence Act, claiming that the electronic evidence lacked certification and compliance with legal standards.

The defense cited previous cases to support their argument that electronic evidence must strictly adhere to statutory requirements. However, the prosecution maintained that the video had already been admitted and that the defense had not challenged its authenticity.

The trial judge ultimately overruled the objections and allowed the video to be played, reserving the ruling on the motion for a later date.
