Court Upholds FCCPC's Probe into Air Peace Complaints

On Monday, the Federal High Court, presided over by Judge James Omotosho, dismissed a suit filed by Air Peace seeking to halt the Federal Competition and Consumer Protection Commission (FCCPC) from investigating multiple complaints from passengers across Nigeria. The complaints primarily allege non-refund of ticket fares for canceled flights.

The court ruled that Air Peace's arguments lacked merit and that the FCCPC has the statutory power to handle consumer complaints. The judge emphasized that the commission can initiate investigations based on received complaints without external limitations.

Air Peace's claim of denial of due process was also rejected, as the court found the suit appeared designed to shield the airline from investigation. The FCCPC had begun receiving complaints against Air Peace in late 2024 and issued a summons for the airline to appear at its Abuja headquarters on June 23, 2025.

Failure to comply could result in sanctions, including fines or imprisonment.
