Odebala Sues NDC and INEC Over Delta Guber Primary Results

Hon. Ejaife Omizu Odebala has initiated legal action against the Nigeria Democratic Congress (NDC), the Independent National Electoral Commission (INEC), and four other defendants in a Federal High Court in Abuja. The suit, marked FHC/ABJ/CS/1636/2026, challenges the outcome of the Delta State governorship primary held on May 29, 2026.

Odebala claims to have received the highest number of votes in the primary and is seeking a declaration that he should be recognized as the winner. The lawsuit, filed on July 29, 2026, by his legal team led by Fredricks Itula, SAN, requests that the NDC and INEC be prohibited from recognizing any other candidate, including the first defendant, for the upcoming 2027 governorship election.

Odebala also seeks an order mandating the NDC to issue him the necessary nomination forms and to replace any submitted names with his as the party's official candidate.
