NBA Condemns Criminalization of Defamation in Nigeria

The Nigerian Bar Association (NBA) condemned the increasing criminalization of defamation during a meeting held on Thursday in Awka, Anambra State. The NBA's National Executive Council expressed concern over reports of individuals being arrested in connection with defamation cases, particularly involving businessman Toni Elumelu.

The NBA criticized the tendency to deploy police powers in matters that should be resolved through civil legal processes. They stated that civil remedies for defamation remain the appropriate channel for redress without resorting to criminal prosecution, which undermines constitutional safeguards, including personal liberty and freedom of expression.

The NBA further warned that the abuse of police power in civil disputes creates a chilling effect on public discourse. They called on law enforcement agencies to exercise restraint and ensure that criminal processes are not improperly invoked in matters that do not disclose recognized criminal offenses under Nigerian law.

The NBA demanded the immediate release of individuals arrested solely for public defamation without established criminal offenses.
