NDPC Warns Content Creators Against Unauthorized Filming

The Nigeria Data Protection Commission (NDPC) issued a warning to content creators regarding the unauthorized filming of unsuspecting citizens, emphasizing that such actions violate the constitutional right to privacy. The warning was prompted by a specific incident involving a content creator filming a reality show on the roadside in Lagos State.

Preliminary investigations indicated that the practice served neither public nor legitimate interest and violated citizens' rights to self-determination as guaranteed under Section 37 of the 1999 Constitution of the Federal Republic of Nigeria and the Nigeria Data Protection Act 2023. Dr. Vincent Olatunji, the Chief Executive of the NDPC, directed social media platform owners, including TikTok and Meta, to enforce community guidelines to prevent harm to individuals.

The NDPC warned that failure to comply could result in appropriate sanctions under the Nigeria Data Protection Act, and content creators could face criminal prosecution for violating citizens' privacy rights.
