SERAP and NGE Sue NBC Over Broadcasting Code Sanctions

The Socio-Economic Rights and Accountability Project (SERAP) and the Nigerian Guild of Editors (NGE) have initiated legal action against the National Broadcasting Commission (NBC) in the Federal High Court in Lagos, contesting the sanctions imposed under the broadcasting code. The suit, filed under case number FHC/L/CS/854/2026, argues that the provisions of the 6th edition of the broadcasting code are vague and overly broad, conflicting with constitutional guarantees of freedom of expression and access to information.

The plaintiffs assert that the NBC's recent caution against broadcasters regarding the presentation of personal views and factual reporting constitutes undue restrictions on journalistic practice. They contend that the regulatory framework lacks clear definitions, leading to arbitrary enforcement against media practitioners.

SERAP and NGE maintain that the NBC cannot justify restrictions based on alleged shortcomings within the media industry, warning that such actions could chill free speech and limit public discourse ahead of the 2027 general elections. They seek a declaration that the contested sections of the broadcasting code are unconstitutional and request an order to invalidate these provisions and prevent the NBC from imposing sanctions.
