UK Sets Five-Year Stay Limit for Foreign Worker Visas

The UK government has clarified that seven visa routes are subject to a five-year maximum stay rule for foreign workers. This regulation stipulates that individuals holding any of the specified visas can only remain in the UK for a maximum of five years within any rolling six-year period.

The rule applies regardless of whether the time spent in the UK was accumulated through multiple visa applications or a single continuous stay. Additionally, applicants must have been employed by their sponsoring employer outside the UK for a minimum of three months immediately before their application date.

This employment condition must be met continuously, meaning any gap in overseas employment within that three-month window could impact eligibility. The five-year rule is particularly significant for workers who frequently use these routes or are transferred to the UK by large organizations, as the cumulative time across all qualifying visa types counts towards the cap.
