US Clarifies Student Visa Rules: Tourist Visas Cannot Cover Degree Programs

The US State Department has set clear boundaries on study activities allowed under visitor visas, requiring separate student visas for formal academic enrollment.

The United States State Department has issued guidance distinguishing between permitted and prohibited study activities for foreign nationals entering on visitor visas. According to the clarification, individuals holding a B-category visitor visa may participate only in short-term recreational courses during their stay.

Any educational pursuit that contributes toward a degree or formal academic credential is strictly prohibited under this visa category, regardless of the intended duration of study. The department outlined seven approved activities for holders of B-2 tourist visas, which explicitly exclude formal academic study and employment.

The B-2 designation covers purely tourist visits, while the B-1 covers business travel, with a combined B-1/B-2 visa available for those whose visits serve both purposes. Foreign nationals seeking to enroll in accredited academic institutions must secure the appropriate student visa before travel and enrollment.

The US government identified six types of educational institutions requiring an F visa for foreign enrollment. These include universities, secondary schools, and language training programs.

Additionally, the State Department specified that vocational and non-academic institutions require an M visa instead. The visa category required depends entirely on the nature of the program and the type of institution, not on the student's nationality or intended length of stay.

For Nigerian students planning US education, securing the correct visa category before departure is mandatory. Attempting to study toward a degree on a B-category visitor visa violates US immigration law.

The distinction between recreational study and degree-granting programs carries legal consequences, making it essential for prospective students to consult official US State Department resources or their nearest US embassy before making travel arrangements.
