U.S. Lists 23 African Nations for Two-Year Residency Rule

The U.S. Department of State has published its Exchange Visitor Skills List, identifying 23 African countries whose nationals in certain specialized fields are required to complete a two-year home-country physical presence requirement under Section 212(e) of the Immigration and Nationality Act.

This requirement applies when an individual completes a J-1 exchange visitor program in a field that matches their country's designated skills. Affected individuals must return to their home country for two years before they can apply for visas such as H, L, or permanent resident status.

A waiver for this requirement is available under limited circumstances, including a no-objection statement from the home country or exceptional hardship to a U.S. citizen or permanent resident spouse or child. This rule significantly impacts many African professionals and students in fields like medicine and engineering participating in U.S. exchange programs.
