FCT High Court Dismisses FHT Mega Express Suit

The Federal Capital Territory (FCT) High Court has struck out a suit filed by FHT Mega Express Limited against Parallax Bank Limited, which claimed ₦7.1 billion. The court upheld Parallax Bank's preliminary objection, ruling that the suit constituted a gross abuse of court process.

The court noted that FHT Mega Express had previously obtained an ex parte order to freeze the bank's funds, which Parallax Bank challenged. The court emphasized that FHT Mega Express had engaged in forum shopping by filing multiple suits in different jurisdictions, including a similar case in Lagos State.

Justice Lewis Allagoa had earlier ordered the parties to maintain the status quo pending the determination of the substantive matter. The court dismissed FHT's suit entirely and awarded costs of ₦500,000 against FHT in favor of Parallax Bank.

This ruling reinforces the judiciary's stance against procedural abuse in commercial disputes and affirms the bank's rights to recover its funds.
