Australia Clarifies Benefits of Prospective Marriage Visa

Australia has published details regarding the Prospective Marriage visa (subclass 300), which is intended for foreign nationals engaged to Australian citizens, permanent residents, or eligible New Zealand citizens. This visa allows holders to live in Australia for a period of 9 to 15 months from the date of grant.

During this time, they can travel in and out of Australia without restrictions. The visa also provides full work rights, ensuring holders are protected under Australian workplace law from their arrival.

Additionally, visa holders may enroll in studies at their own expense, as no government funding is available. After marriage in Australia, couples wishing to remain permanently must apply for a Partner visa (subclasses 820 and 801) before the Prospective Marriage visa expires.

It is crucial for those outside Australia when the visa is approved to enter the country before the first entry arrival date stated in their grant letter. If a baby is born after the visa is granted, authorities must be notified, but adding family members to the visa is not permitted.
