Australia Outlines Key Reasons for Visa Cancellation

The Department of Home Affairs in Australia has published a formal outline detailing the circumstances under which a foreign national's visa may be canceled. The authority to grant, refuse, or cancel a visa lies solely with the Minister for Immigration or an officially appointed delegate.

Cancellations can be discretionary, mandatory, or occur by operation of law under the Migration Act 1958. The Department listed five primary reasons for visa cancellation: 1) failure to comply with visa conditions, 2) provision of incorrect or fraudulent information during the application process, 3) being deemed a risk to the Australian community, 4) being charged with or convicted of a criminal offense, and 5) not meeting character requirements at the time of assessment or subsequently.

Visa holders will typically be notified before cancellation and can present reasons against it. A canceled visa may also lead to the cancellation of visas for family members linked to the individual.
