US Judge Strikes Down Visa Ban Affecting Nigeria

On a recent Friday, US District Judge Jeannette Vargas ruled against a visa ban implemented by the Trump administration, stating that the policy exceeded the statutory authority of Secretary of State Marco Rubio. The ruling declared the policy, which categorically prohibited the issuance of immigrant visas based on nationality, as “patently unlawful” and in violation of federal immigration law.

The policy, announced by the State Department in January, affected applicants from various countries, including Nigeria, Brazil, Colombia, and others across Latin America, the Balkans, South Asia, Africa, the Middle East, and the Caribbean. The State Department had justified the suspension by claiming that applicants from these countries posed a high risk of becoming public charges.

The lawsuit was filed by immigrant rights groups, including the Catholic Legal Immigration Network and African Communities Together, alongside immigrant-visa applicants and U.S. citizens sponsoring family members. The ruling represents a significant legal challenge to the Trump administration's immigration policies.
