UK Sets Conditions for Parents Seeking Permanent Residency

In 2026, the UK government published guidance detailing five conditions that parents holding a family visa must satisfy to qualify for indefinite leave to remain (ILR) through their children. The conditions apply to parents whose children are either British citizens or holders of ILR.

The requirements for parents on the 5-year route include: the child must be under 18 at the time of the ILR application, the parent must have lived in the UK continuously on a family visa for at least five years, the parent must demonstrate financial independence, and applicants aged 18 to 64 must pass the Life in the UK Test and meet English language requirements. Additionally, parents with a partner eligible for a partner visa cannot apply for ILR as a parent.

For the 10-year route, parents must have lived in the UK for at least 10 continuous years, with different conditions regarding financial requirements and the age of the child. Documentation proving the relationship to the child and evidence of income and accommodation are required for the application.
