UK Sets Out Rules for Adult Dependent Relative Visa Holders Seeking Settlement

The UK has clarified eligibility requirements and settlement pathways for foreign adults who depend on UK-based relatives for care and support.

The United Kingdom has released formal guidance on how foreign adults can obtain permanent residency through the Adult Dependent Relative visa category. The scheme allows individuals who rely on a family member already living in Britain for personal care to migrate and eventually settle in the country.

The UK government's published rules now spell out both the qualifying conditions and the pathways to achieving indefinite leave to remain, the legal status required for permanent settlement. To qualify for this visa route, applicants must satisfy four core requirements.

They must be at least 18 years old and already possess valid permission to enter the UK under this specific visa category. Additionally, they need a sponsor—a family member with settled immigration status in Britain—who will financially support them without drawing on public funds.

These conditions ensure that visa holders do not become a burden on the UK welfare system and that a responsible family member is committed to their care. The settlement process depends entirely on the sponsor's immigration status.

Applicants whose sponsors are British citizens or hold settled status receive immediate indefinite leave to remain upon arrival. Those whose sponsors hold other forms of temporary permission instead receive initial temporary stay grants, with settlement opportunities tied to their sponsor's future status changes.

This structure means Nigerian applicants and others from abroad must carefully assess their sponsor's current immigration position before applying. The UK has also exempted Adult Dependent Relative visa holders from two standard tests required for most other settlement applicants.

These individuals do not need to pass the English language proficiency examination or complete the Life in the UK test, which assesses knowledge of British culture and civic values. This exemption recognises the age and care circumstances of this visa category's typical applicants, who may face barriers in meeting these requirements.
