Atiku Abubakar Proposes Petrol Subsidy Amid Legal Concerns

At a press conference in Abuja, Alhaji Atiku Abubakar reiterated his proposal for a "production subsidy" aimed at reducing pump prices for locally refined petrol. He called on President Bola Tinubu to lower diesel and petrol costs.

This proposal raises significant legal, fiscal, and practical questions, particularly in light of Section 205(1) of the Petroleum Industry Act 2021, which mandates that market conditions dictate petroleum product prices. The Nigerian Midstream and Downstream Petroleum Regulatory Authority clarified that it does not set pump prices unless specific market failures are declared, which has not occurred.

Atiku must clarify whether subsidized refineries would have price conditions and how public support would ensure lower consumer prices. He also needs to disclose the proposal's cost, estimated between N17 trillion and N21 trillion annually, and the funding source.

Key details required include the subsidy rate, spending ceiling, volume covered, funding source, price guarantee mechanisms, and potential amendments to the Petroleum Industry Act.
