EFCC Seeks Supreme Court to Overturn Ajudua's Bail

The Economic and Financial Crimes Commission (EFCC) has approached the Supreme Court of Nigeria to set aside the bail granted to Fred Chijindu Ajudua, who is facing charges related to a $1.043 million fraud. The EFCC filed a notice of appeal on February 20, 2026, challenging the decision made by the Court of Appeal on January 30, 2026, which admitted Ajudua to bail.

The EFCC, represented by S.K. Atteh, contends that the Court of Appeal erred in dismissing the prosecution's preliminary objections and improperly interpreted a prior Supreme Court judgment delivered on May 9, 2025.

This earlier ruling explicitly ordered that Ajudua remain in custody pending a speedy trial. The EFCC argues that the Court of Appeal's reliance on a medical report dated November 19, 2025, which cited Ajudua's kidney-related ailment, was a misinterpretation of circumstances warranting bail.

The EFCC insists that the Supreme Court's decision is final and binding on lower courts, and thus, the appeal court's actions violated constitutional provisions.
