EFCC Appeals Bail Decision for Ajudua in Fraud Case

The Economic and Financial Crimes Commission (EFCC) is appealing to the Supreme Court of Nigeria to revoke the bail granted to Audu Ajudua by the Appeal Court on January 30, 2026. Ajudua is accused of defrauding Palestinian businessman Zad Abu Zalaf of $1.043 million.

The EFCC's counsel, S.K. Atteh, contends that the Appeal Court failed to properly interpret a Supreme Court judgment from May 9, 2025, which should have foreclosed further consideration of bail.

The EFCC argues that the Appeal Court's decision violates sections 235 and 275(1) of the 1999 Constitution, asserting that the Supreme Court's decisions are final and binding on lower courts. The EFCC also criticized the Appeal Court's reliance on Ajudua's medical report, which cited a kidney ailment dating back to 1987, claiming it was inconsistent and did not warrant bail.

The EFCC urges the Supreme Court to restore the trial court's ruling from November 20, 2025, which had previously denied bail.
