Appeal Court Nullifies ADC Congresses Led by David Mark

The Appeal Court has nullified the congresses of the African Democratic Congress (ADC), affirming a judgment that restrains the Independent National Electoral Commission (INEC) from recognizing the state congress organized by a committee appointed by David Mark. A three-man panel led by Justice Abba Moham delivered the judgment, with Justice Okon Abang and Justice Donatu Okorowo upholding the restraining order issued by Justice Joyc Abdulmalik on April 29.

The Appeal Court found no reason to set aside the restraining order given by the Federal High Court in Abuja, which had previously restrained the Mark-led ADC executive from functioning. The court noted that the conduct of state congresses is a political party matter and should be addressed by the national leadership.

Justice Moham stated that the trial court was wrong to assume jurisdiction over the matter, emphasizing the Supreme Court's pronouncement on party affairs.
