The Australian Government Department of Home Affairs has issued guidance regarding who is legally permitted to assist foreigners with their visa applications. The department specifies that immigration assistance includes activities such as preparing visa applications, advising on visa matters, and representing individuals in related proceedings.

Only three categories of individuals are authorized to provide such assistance: registered migration agents, legal practitioners, and exempt persons. The guidance warns that individuals seeking help from unqualified sources risk improper handling of their applications, which could adversely affect their visa outcomes.

This warning is particularly pertinent for those navigating the visa system from abroad, where unlicensed advisers may offer assistance for a fee. The department emphasizes that any assistance from individuals outside the approved categories is not legally recognized, regardless of any agreements made between the applicant and the adviser.
