Supreme Court Returns ADC Leadership Case to Trial Court

On Thursday, the Supreme Court of Nigeria issued a unanimous judgment regarding the leadership tussle within the African Democratic Congress (ADC), returning the case to the Federal High Court for resolution. The apex court set aside the status quo ante bellum order previously established by the Court of Appeal.

Justice Moham Garba, who delivered the lead judgment, stated that the lower court was incorrect in raising issues sua sponte, which were not requested by the parties involved. The Supreme Court deemed the status quo ante bellum order inappropriate, as it preserved the case while pending trial in the lower court.
