David Mark Seeks Court Reversal of INEC's Decision

David Mark, the national chairman of the African Democratic Congress (ADC), has filed a suit at the Federal High Court in Abuja seeking to reverse the Independent National Electoral Commission's (INEC) decision to withdraw recognition of his leadership. Mark's legal team, led by Sulaiman Usman, argued that INEC's actions created a vacuum in the party's leadership structure and were inconsistent with a prior court appeal order.

Justice Emeka Nwite ruled against Mark's request for an injunction to restrain INEC from recognizing his leadership, stating that the court lacked jurisdiction to entertain the suit. The court deemed the application premature and emphasized the need to maintain the status quo until the substantive suit is determined.

Mark's motion, filed on April 2, 2023, sought to set aside INEC's refusal to attend and monitor the ADC's congress and restore his name to the party's official records.
