Supreme Court Allows Global Gas to Amend Appeal Against Shell

On May 22, 2026, the Supreme Court of Nigeria granted Global Gas and Refining Limited permission to introduce fresh issues in its amended appeal against Shell Petroleum Development Company of Nigeria Limited concerning a Gas Processing Agreement (GPA). A five-man panel led by Justice Inyang Okoro ruled on the matter.

Global Gas had previously sought an order to restrain the Nigerian Upstream Petroleum Regulatory Commission from approving the $1.3 billion sale of Shell's assets to Renaissance Consortium, citing an unresolved wet gas dispute. Following the appointment of Kanu Agabi, SAN, as lead counsel, Global Gas applied to amend its appeal.

Shell's legal team, led by Tonye Krukrubo, SAN, opposed this amendment, arguing it would alter the nature of the appeal. However, Justice Adamu Jauro ruled that Shell did not demonstrate any prejudice that could not be compensated and emphasized the importance of hearing all relevant issues, especially given the decade-long dispute.

The court found that the amendments were made in good faith and aimed at a comprehensive resolution.
