Court Rules Against Police Fines for Insurance Violations

On Friday, a Federal High Court in Abuja, presided over by Justice Hauwa Yilwa, delivered a significant judgment that prohibits the Nigeria Police Force and the Federal Road Safety Corps (FRSC) from fining motorists for third-party motor insurance violations without a prior court ruling. This decision arose from a legal challenge initiated by human rights activist and lawyer Deji Adeyanju against the Inspector General of Police and the Attorney General of the Federation.

The court examined the provisions of the Motor Vehicle (Third Party Insurance) Act and determined that while the police and FRSC have the authority to conduct stop-and-search operations to verify insurance documents, they lack the legal standing to impose fines directly on motorists. The ruling aims to protect citizens from arbitrary penalties and potential extortion.

Counsel Marvin Omorogb explained that the court's decision creates a clear boundary regarding the enforcement powers of these agencies. The FRSC indicated plans to appeal the ruling, raising concerns about the court's jurisdiction in the matter.
