Court Upholds KC Luxury's 30-Day Detention for Drug Case

A Lagos court has ruled in favor of extending the detention of socialite Afolabi Kazeem Michael, known as KC Luxury, for an additional 30 days due to his alleged involvement in hard drug peddling. Justice Akintayo Aluko delivered the ruling on Thursday, affirming the validity of the August 20 detention extension order under the Constitution and relevant drug-control laws.

KC Luxury’s lawyer, Abdulakeem Labi-Lawal, contended that the Federal High Court lacked jurisdiction to extend the detention, asserting that such orders should only be issued by a magistrate’s court according to the Administration of Criminal Justice Act (ACJA). However, the agency's lawyer, Ibrahim, clarified that the order was not a remand order but an extension for further investigation.

Justice Aluko agreed, stating that the ACJA provisions cited by KC Luxury did not apply and that the court had exclusive jurisdiction over drug-related offenses, establishing reasonable suspicion against him. KC Luxury was arrested on August 13 at Murtala Muhammed International Airport while preparing to travel to Paris.
