Legal Expert Calls for Clarity on Tinubu's Absence

Justice Osai Ahiakwo, a legal practitioner and public commentator, has called on the National Assembly to clarify the constitutional implications of President Bola Tinubu's extended absence from Nigeria, which began on August 30 for a three-week working vacation in Europe. The Presidency announced that Tinubu's return was expected at the weekend, while Vice-President Kashim Shettima is in New York representing Nigeria at the 81st United Nations General Assembly.

Ahiakwo referenced Section 145(1) of the 1999 Constitution, which requires the President to transmit a written declaration to the President of the Senate and the Speaker of the House of Representatives when proceeding on vacation or unable to perform presidential duties. He noted that if such a declaration was not made within 21 days, the National Assembly could authorize the Vice-President to act as President.

Ahiakwo stressed that the absence of the President does not create a vacancy in the office and that the constitutional provisions should be followed rather than political discourse.
