NASS Limits INEC's Power on Certificate of Return Issuance

The Nigerian National Assembly has enacted reforms in the electoral process, particularly affecting the Independent National Electoral Commission (INEC). Senate Leader Opeyemi Bamidele highlighted that the new Electoral Act includes a provision (Clause 72(2)) allowing courts to order the swearing-in of elected officials if INEC refuses to issue Certificates of Return.

This change aims to address issues where INEC neglects its duty, potentially causing harm to elected candidates. Furthermore, the reforms mandate that INEC must release true copies of relevant documents within 24 hours of payment, with non-compliance resulting in a minimum two-year imprisonment.

The new legislation also establishes a dedicated fund for INEC to ensure financial autonomy and operational stability. Additionally, the reforms raise spending limits for various elections, including presidential and gubernatorial polls, to enhance participation and reduce corruption in the electoral process.
