Ugbebor Appeals Court Ruling on Oak Home Dispute

Engin Anthoni Ehiedu Ugbebor is appealing a June 15, 2026 judgment by Justice Akingbola Georg of the Lagos State High Court, which dismissed his claims against Oak Home Multin Services Limited. Ugbebor contends that the trial judge misapplied contract law principles and ignored material evidence, wrongfully dismissing his counterclaim and refusing his request for specific performance of a property sale agreement.

The appeal stems from suit no. LD/4471LM/2023, where Ugbebor seeks the handover of two luxury apartments located in Victoria Island, rejecting a court-ordered refund of N152 million.

He argues that the original agreement remains valid and enforceable, asserting that the trial court incorrectly placed the burden of proof on him regarding payment timelines, despite evidence showing he had paid 80% of the purchase price. Ugbebor maintains that the conduct of the parties did not create a new contractual relationship, as claimed by the trial court, and urges the appellate court to compel Oak Home to honor its contractual obligations.
