South Africa's Court Denies Detention of Chidimma Adetshina

South Africa's Department of Home Affairs attempted to detain Chidimma Adetshina, the former Miss Universe Nigeria, during her ongoing deportation case. During the proceedings at the Cape Town Regional Court on Monday, state lawyers argued that Adetshina lacked the necessary immigration documents to remain in South Africa and should be held in detention pending deportation.

However, the court, presided over by Magistrate Reema Khorana, did not rule in favor of the state's request and reserved judgment on the detention issue until August 19, urging both parties to consider an out-of-court settlement, which ultimately did not materialize. Prosecutors claimed that Adetshina retained a South African passport despite holding Nigerian citizenship and alleged that she obtained Nigerian travel documents in Lagos before re-entering South Africa via Mozambique.

Adetshina's legal team countered that she has no significant ties to Nigeria and proposed that she report to an immigration officer biweekly instead of being detained. The case is complicated by a recent ruling from the Western Cape High Court, which stated that magistrates lack the authority to issue arrest warrants for immigration detention.
