Supreme Court Rules on Eurafr Oil Field Licensing Case

The Supreme Court of Nigeria, on a Thursday, ruled that the previous court's decision regarding the Eurafr case was perverse and unsustainable. The case involved the licensing of the Daw Island margin oil field, previously operated by Eurafr, whose license expired in April 2019.

The Department of Petroleum Resources (DPR) had recommended the non-renewal of Eurafr's license due to the field's lack of development over several years. The Supreme Court found that the Eurafr case was incompetent due to the non-joinder of the DPR, which is responsible for regulating the oil and gas industry.

The court stated that the DPR must be included in any proceedings related to licensing and that the absence of the DPR rendered the case null and void. The court also highlighted the importance of fair hearing rights, as the DPR was not given an opportunity to present its case.

The ruling underscores the critical role of regulatory bodies in oil sector disputes.
