Court Rejects Aiteo's Objection in Oil Spill Case

On Tuesday, a Federal High Court in Yenagoa dismissed a preliminary objection filed by Aiteo Group in a lawsuit initiated by the Opu Nembe Kingdom concerning an alleged oil spill that adversely affected the community. Aiteo argued that the lawsuit incorrectly identified it as "Aiteo Eastern Exploration and Production Company Ltd," instead of its proper corporate name, "Aiteo Eastern E&P Company Ltd," claiming this misidentification rendered the suit defective.

However, Justice Emmanuel Ayo ruled that technical issues should not obstruct substantive matters raised in the case. The court noted that the plaintiffs had already filed a motion to correct the name of the defendant, which further supported the court's decision to reject Aiteo's preliminary objection.

The matter has been adjourned to April 16, 2024, for a ruling on the motion to amend the defendant's name. The lawsuit seeks to declare that the oil spill caused operational failure and negligence on the part of the oil company, with significant environmental and economic impacts on the community.
