APGA Files Lawsuit to Halt Imo LG Elections Over Defects

The All Progressives Grand Alliance (APGA) has initiated an urgent legal action at the High Court of Imo State, Owerri Judicial Division, to prevent the Imo State Independent Electoral Commission (ISIEC) from conducting Local Government Council elections on September 26, 2026. The suit, numbered HOW/1380/2026, was filed on September 16, 2026, by APGA and four of its executives: Hon. John C.

Iwuala (State Chairman), Engr. Udensi Samuel Iheanyi (State Organizing Secretary), Pastor Alphonsus Eberendu (State Secretary), and Hon. Mrs. Nkasi Obi (State Woman Leader). They argue that the electoral process is unlawful due to two main statutory defects: the "360 Days' Notice of Election" issued by ISIEC on September 18, 2025, was invalid as it did not specify an election date, violating Section 28 of the Electoral Act.

Additionally, a subsequent press release on September 11, 2026, which announced the election date, was issued too close to the election to rectify the earlier defect. The plaintiffs reference a Supreme Court ruling from February 28, 2025, which nullified elections for similar non-compliance with electoral laws, asserting that the current electoral process is based on a repealed statute.
