Denmark Exempts Six Foreign Groups from Permit Expiry Rules

Denmark has confirmed that six groups of foreign nationals are exempt from the standard rules that typically cause residence permits to expire. Under Danish law, a residence permit can lapse if the holder ceases to maintain residence in the country or spends more than 12 consecutive months outside Denmark.

This can unexpectedly affect long-term residents, particularly those whose work or study commitments require them to be abroad for extended periods. The six exempt categories allow individuals in these groups to retain their temporary permits without the risk of losing them due to prolonged absences.

However, a critical detail is that once an individual successfully obtains permanent residence, these exemptions no longer apply. A permanent residence permit can also lapse if the holder does not maintain residency or remains outside Denmark for over 12 months consecutively, which may catch individuals off guard, especially those who have spent years working abroad under specific schemes like the Fast-track or Researcher programs.
