Falana Critiques UK-Nigeria Deportation Agreement Validity

Femi Falana, a senior lawyer, has warned that the UK-Nigeria agreement on deportation cannot be enforced as it undermines Nigeria's constitutional protections and international human rights obligations. The agreement, unveiled during President Bola Ahmed Tinubu's state visit to the UK, aims to expedite the return of Nigerians without legal status, including failed asylum seekers and convicted offenders.

Falana criticized the arrangement, arguing that it prioritizes administrative convenience over due process, increasing the risk of wrongful deportations. He contended that the agreement violates Nigeria's obligations under international treaties, such as the African Charter on Human and Peoples' Rights and the International Covenant on Civil and Political Rights, which guarantee protection of human dignity and access to legal remedies.

Falana also highlighted the potential negative impact on family life and emphasized the need for any deportation decisions to consider the best interests of children. He questioned the legal validity of the agreement within Nigeria's domestic framework, asserting that existing laws prohibit the detention of individuals without a valid court order.
